"TERMS & CONDITIONS"

AegeanCruising.Com is a trading name of Novella Yachting (Novella Yat Isletmesi, Turizm ve Ticaret A.S.) whose registered office is Cafer Pasa Cad. No: 55, Bodrum - Turkey and whose principal place of business is at Neyzen Tevfik Cad, Yangi Sok, No: 12, Bodrum - Turkey. These booking conditions have been formulated as a result of our responsibilities under law. They do not affect you statutory rights.
1- BOOKING AND DEPOSIT: When you make a booking you undertake that you have the authority to accept and do accept these booking conditions on behalf of yourself and your party. To make a booking you must complete and sign the booking form and pay 40% of the total holiday cost as a deposit. If you book a Private Yacht Charter holiday there will another agreement which we will send you to sign. You need to return the Private Yacht Charter Agreement to us after you signed it. If the deposit is not paid till the date shown on your final confirmation we reserve the right to cancel your travel arrangements and levy the cancellation charges set out below. The balance due must be paid on arrival to the yacht in cash or travellers cheque (Early Booking and Special Offer payment conditions may vary).
2- LATE BOOKING: If intended departure date is within 8 weeks, then the total holiday cost is payable in full at the time of booking.
3- PRICES AND SPECIAL OFFERS: Whilst we reserve the right to change our prices at any time before you book, including any special offers we from time to time have, which may or may not be the same as the brochure/website price, the price of your holiday as agreed with you, as shown on your confirmation will not be increased, unless where goverment actions such as VAT, currency and fuel increases apply.
4- CHANGES BY YOU: If you want to change any detail of your booking after you have been sent confirmation we will do our best to help. You must confirm any changes you are requesting in writting to Novella Yachting.
5- CANCELLATIONS: If you have to cancel your booking for any reason the following charges will apply;
60 days or more: Loss of deposit
59 - 45 days before departure: 50% of holiday cost
44 - 21 days before departure: 75% of holiday cost
thereafter: %100 of holiday cost.
No refund will be due to you if you wish to cancel your holiday after it has started for the unused portion of the travel arrangements made for you.
In any refund made to you is subject to deduction of the international Bank charges.
6- CHANGES BY US: It is unlikely that we will have to amend your booking. Occasionaly changes may be made which we reserve the right to do at any time. Most of these changes are minor and we will advise you at the earliest possible date. If a major change occurs we will notify you as quickly as possible and you will have the choice of (a) accepting the changed arrangements, (b) purchasing another available holiday from us, or (c) cancelling or accepting the cancellation and receiving a full refund of all money paid to us. Please note that we cannot accept liability or responsibilty for or offer compensation in respect of circumstances where performance of the agreement is prevented by reason of force majeure, war, threat of war, riot, natural and nuclear disaster, industrial dispute, terrorist activity, fire, adverse weather conditions, civil strife, earthquakes or other similar events beyond our control.
7- CONTACT: We reserve the right in our absolute discretion to terminate your and your parties holiday arrangements without notice should your or any of your parties behaviour be such that it is likely in our opinion to cause distress, damage, annoyance or danger to any other person or to property. In such circumstances, no refund or compensation or costs incurred will be due to you.
8- INSURANCE: You must provide your own travel insurance. Where any watersports are advertised as being available, we cannot offer any assurance with regard to the participants safety. Also it must be noted that many insurances exclude them as a hazardous pusuit. We are unable to accept the responsibilty for any costs you or anyone in your party may incur as a result of failing to take out adequate insurance cover.
9- OUR LIABITY TO YOU: We accept responsibilty for the negligent acts and/or omissions of our employees, agents, sub-contractors and suppliers while acting within the scope of or in the course of their employment with us and for any deficiencies in the services we are contractually abligied to provide or the failure of such services to reach a reasonable standard. In any such case our liablity shall be limited to a maximum of twice the original holiday cost. We do not accept responsibilty in respect of death, bodily injury or illness of any person taking one of our holidays except when caused by the negligents acts and/or omissions of our employees, agents, sub-contractors or suppliers whilst acting the scope of or in the course of their employment agency contract of supply or sub-contract although where the service in question consist of carriage by air, by sea or rail or the provision of accommodation, the limit of our liability shall be as provided for under applicable law and/or international convention.
10- COMPLAINTS: In the event of you having any cause for complaint during you holiday you must immediately inform our representative (or captain). Our representatives will of course do their best to remedy matters, they may also require you to comlete a written complaint. In order to investigate this fully, you must write Novella Yachting giving full details so that we receive this no later than 28 days after your return date, failing which we will have no liabilty to you.
11- JURISDICTION: The contract arising from any confirmed holiday bookings is to interpreted under and is subject to the laws of Turkey. Both parties agree to submit any dispute or claims under it to the Bodrum Courts.
